Nonresident - Absence related to contract

Question on this -- "the taxpayer may visit CA so long as the taxayer does not spend more than 45 days in the aggregate during a taxable year."

If the taxpayer lives in CA from Jan-June, then move to foreign country with an employment contract expected to last 3 years.  The taxpayer visit CA 2 weeks from July-Dec.  Does the fact that the taxpayer was a resident from Jan-June taint the 45 days?

Yes the 45 day period starts when they leave so we believe they qualify. Starting in 2017 the 45 days will apply
