    Does CA filing status have to follow the federal ? Can taxpayers file “married filing separate” for federal, but file jointly for California ?

    IF a t/p files married filing separate for federal they must file separately for CA as well. If they file marreied for federal they can file separate for CA. See FTB Pub. 1051

    According to the first page of the 2018 Instructions for Form 540, “Use the same filing status for California that you used for your federal income tax return.”  Plainly stated.  The instructions then list only two exceptions, for active military and some non-residents, and the special rules for registered domestic partners.
