    Hello:

    I attended the recent update seminar on the 250 hour rule under safe harbor. Would like to confirm if a person has only one rental property, which I assume he is still considered as rental estate enterprise,  he would be still subject to the safe harbor rules to get the deduction. If he doesn’t have the 250 hour, is he then still eligible for the 20% deduction. Still a little confused.

    If he doesn’t meet the safe harbor then you have to determine whether the single rental constitutes a trade or business under IRC Sec. 162.
