The IRS has announced filing and payment postponement relief for individuals and businesses in 46 of Florida’s 67 counties (see box below) that were impacted by Hurricane Idalia. (IR-2023-159; FL-2023-06) The IRS announcement acknowledges that additional counties may be added.
Similar relief was made for taxpayers located in counties impacted by the Maui wildfires (see www.caltax.com/news/hot-news-and-notes/filing-and-payment-relief-for-maui-wildfires/).
The Florida tax relief postpones various tax filing and payment deadlines that occurred from August 27, 2023, through February 15, 2024 (the postponement period).
This means, for example, that the February 15, 2024, deadline will now apply to:
- Individuals who had a valid extension to file their 2022 return, due to run out on October 16, 2023. The IRS noted, however, that because tax payments related to these 2022 returns were due on April 18, 2023, those payments are not eligible for this relief;
- Quarterly estimated income tax payments normally due on September 15, 2023, and January 16, 2024;
- Quarterly payroll and excise tax returns normally due on October 31, 2023, and January 31, 2024;
- Calendar-year partnerships and S corporations whose 2022 extensions were due to run out on September 15, 2023;
- Calendar-year corporations whose 2022 extensions were due to run out on October 16, 2023; and
- Calendar-year tax-exempt organizations whose extensions were due to run out on November 15, 2023.
In addition, penalties for the failure to make payroll and excise tax deposits due on or after August 27, 2023, and before September 11, 2023, will be abated as long as the deposits are made by September 11, 2023. Other deadlines falling within the postponement period will also be extended if they are listed in Rev. Proc. 2018-58. This includes the 45- and 180-day deadlines for IRC §1031 like-kind exchanges.
Taxpayers do not have to be directly impacted to qualify for relief if they reside in or their business is located in one of the listed counties. Taxpayers residing or located in one of the listed counties do not have to apply for relief.
In addition, taxpayers who live or are located outside the impacted counties but whose tax professional is located in one of the counties may also qualify for relief. These taxpayers should contact the IRS disaster hotline at (866) 562-5227 to request relief.
