Beginning July 1, 2020, tax preparers applying for a new registration with the California Tax Education Council (CTEC) must submit fingerprint images and submit to a background check. (B&PC §22251.3)
Note: This requirement does not apply to CTEC-registered tax preparers (CRTPs) who have already registered with CTEC prior to July 1, 2020.
Also beginning July 1, 2020, if a CRTP allows their CTEC registration to expire, or has their registration revoked, in order to re-register with CTEC, they not only will be required to retake the 60-hour qualifying education course, but they will also be required to go through a background check and submit fingerprint images to CTEC, even if they had done so in the past.
This new requirement is part of AB 3143 (Ch. 18-597), also known as “The Tax Preparation Act.” Starting last June, this legislation required CRTPs to report claims against their bonds to CTEC.
CTEC is required to publicly post disciplinary actions taken against a CRTP, including misconduct resulting in suspending or revoking a registration. All actions taken against a CRTP, including bond claims, are posted on the CTEC website.
