Federal legislation proposed to address Wayfair

H.R. 6724, the “Protecting Businesses from Burdensome Compliance Cost Act of 2018,” was introduced in Congress this week. If enacted, the bill would:

  • Prohibit a state from requiring a remote seller to collect and remit until after January 1, 2019 (the proposed effective date of the act);
  • Require a uniform statewide rate; and
  • Prohibit subdivisions of states from requiring collection by remote sellers.

To date, there has been no action on this bill.
